Abstract: [Name removed], fired from his job at a New Jersey Disney store, filed an employment discrimination claim under the Americans with Disabilities Act (ADA) while applying for Social Security benefits. The 3rd U.S. Circuit Court of Appeals must now determine whether or not these dual claims are legal. Prior to his termination, [name removed] applied for Social Security benefits based on his AIDS diagnosis and AIDS-related illness. Under Social Security, a person living with AIDS automatically qualifies for benefits regardless of his ability to work. Disney claims that [name removed] was terminated for taking money from the cash register without authorization. A U.S. District Court held that [name removed] forfeited his rights to ADA protection because he applied for Social Security benefits.
