    Abstract:
    A three-judge panel of the Tennessee Court of Appeals upheld a lower court's dismissal of a lawsuit filed by the plaintiff. The plaintiff's insurer, Paul Revere Life Insurance Company, refused to pay disability benefits after learning that he had failed to state in his application that he was HIV-positive. The policy clearly states that it will eliminate coverage for illnesses that manifest themselves prior to the issuance of the policy.
