  • Title: Lawmakers favor looser time limit on death benefit requests.

    Abstract:
    The California Legislature seeks to extend the statute of limitations for workers to file HIV-related death benefits for job-related HIV transmission. Current law for filing death claim benefits does not account for the slow progression of HIV disease. Death may occur well past the 240-week limitation rule that begins from the start of the injury. The bill would amend the current law to allow for death benefit applications within 1 year of the worker's death provided certain conditions are met. The bill would apply to workers who were directly exposed to blood or body fluids on the job. Police officers, sheriff's deputies, and firefighters are included in the provision.
