Abstract: In finding a 24-hour waiting period between consent and abortion unconstitutional but holding that such a provision could be struck from the Illinois Parental Notice Abortion Act without invalidating the entire Act, the U.S. Court of Appeals, Seventh Circuit, partly vacated and remanded a decision of the U.S. District Court for the Northern District of Illinois. The Court of Appeals applied the decision of the U.S. Supreme Court in City of Akron v. Akron Center for Reproductive Health to unemancipated minors. The rest of the statute was not to be enforced until the Illinois Supreme Court set forth rules to assure the confidentiality of proceedings when a pregnant minor sought to waive the parental notification requirement.[Abstract] [Full Text] [Related] [New Search]
