    Abstract:
    On remand from the U.S. Supreme Court, the U.S. Court of Appeals for the Third Circuit found that a patient had been confined in subhuman conditions during most of the 24 years of his confinement in a New Jersey state hospital. Upon consideration of the case in light of Youngberg v. Romeo, the Court of Appeals found that the patient's right to adequate treatment had been violated. Moreover, further evaluation would be made at a new trial concerning the patient's claim that he should be assigned to a less restrictive setting within the state hospital.
