Abstract: The United States Court of Appeals, Fifth Circuit, found provisions of the Louisiana abortion statute unconstitutional, thus affirming a decision of the United States District Court for the Eastern District of Louisiana. The court struck down the provision of the statute that required the attending physician to notify the woman within 24 hours after performing the abortion that she could choose to have the fetus cremated, buried, or disposed of as waste tissue. In addition, the provision prohibiting any experimentation on the fetus before or after abortion was found to be unconstitutionally vague.[Abstract] [Full Text] [Related] [New Search]
