Abstract: The U.S. District Court, E.D. Pennsylvania, temporarily enjoined implementation of certain 1988 amendments to Pennsylvania's 1982 Abortion Control Act, on the grounds that irreparable harm to the rights of pregnant women would otherwise ensue. First, the Act as amended fails to provide sufficient confidentiality for minors resorting to judicial bypass procedures to obtain abortions. Second, its requirement for public inspection of reports that include the identification of the referring physician, weight and length of the fetus, and basis of medical judgment for performing an abortion do not serve the state's interests. Third, it is inappropriate to require physicians to determine the viability of a fetus prior to performing an abortion subsequent to the nineteenth week of pregnancy. Finally, the statute does not clearly place the mother's life above that of the fetus in emergency situations.
