  • Title: American Academy of Pediatrics v. Lungren.
Author: California. Court of Appeal, First District, Division 1.
Journal: Wests Calif Report; 1994 Sep 29; 32():546-62. PubMed ID: 11648640.
    Abstract:
The Court of Appeal of California agreed with a lower court decision that had found unconstitutional a statute requiring a minor to obtain parental consent before undergoing an abortion. The Court of Appeal ruled that an adolescent has a fundamental right to privacy, particularly the right to decide whether or not to bear a child. A minor's right to privacy supercedes a parent's right to guide or to influence a minor's decisions. A state statute that violates a minor's right to privacy must further a compelling state interest.
