    Abstract:
    The Ohio Supreme Court held that a patient cannot sue for damages for "wrongful living" as a result of the wrongful administration of life-prolonging medical treatment. Instead, damages for prolongation of life must be based on either negligence or battery. Despite a do-not-resuscitate order, a nurse at St. Frances-St. George Hospital revived Edward Winter, who suffered a paralyzing stroke two days later. Although Winter was alive to suffer the stroke, numerous injuries could have followed resuscitation, and thus revival did not cause the stroke. The court reviewed other valuation of life cases involving "wrongful life" and "wrongful birth," and linked the claim for "wrongful living" to a refusal of treatment based on the liberty interest underlying the Cruzan right to die.
