    Abstract:
    The Ohio Court of Appeals for Hamilton County upheld summary judgment on a claim for wrongful living, where the patient was resuscitated by a nurse contrary to his doctor's no code blue order and then later suffered a paralyzing stroke prior to his death. Wrongful living was the phrase coined by the appellant for the cause of action for the life that was forced on the decedent by resuscitation. The court noted that life was not a compensable harm in the state until the legislature or the highest court decides it is so. Because the patient had apparently expressly refused treatment in a medical emergency, the case could proceed under two other theories, battery or unauthorized touching, and negligence or breach of a duty of care.
