    Abstract:
    The U.S. Supreme Court refused to uphold an order forcing a defendant, over his objection, to be administered an antipsychotic drug while on trial. The Court held that due process would not be satisfied with respect to forced drug administration unless it were shown there were no less intrusive alternatives, the medication was medically appropriate, and the treatment was essential for the safety of the defendant or others. The Court refused to consider the sentencing argument asserting the medication obscured the defendant's true mental condition. Finally, the Court held that the expert testimony regarding the drug's effect on the defendant did not compensate for the possibility that the results were compromised by forced administration of the drug.
