Title: [Legal bases of surgical sterilization of men and women in the German Federal Republic]. Author: Spann W. Journal: Geburtshilfe Frauenheilkd; 1975 Jul; 35(7):501-3. PubMed ID: 1213262. Abstract: Legal aspects of male and female sterilization in West Germany are discussed. Not only the informed consent of the patient is necessary: the operation must not be "contrary to public custom." Medical indications are acceptable, as are medicosocial indications; no question of custom can exist here. Although the physician's responsibility in cases of euginic indications is greater, there is no question of legality when he acts in accordance with his professional judgement. The same situation exists in the case of "vicarious" sterilization (especially of the man); here, the possibility of a new marriage (after death or divorce) of the sterilized partner must be considered, however.
