Title: The Children's Law Act, 1988, 8 July 1988. Author: Canada. Newfoundland. Journal: Annu Rev Popul Law; 1988; 15():136, 516-23. PubMed ID: 12289198. Abstract: This document contains provisions of Newfoundland's 1988 Children's Law Act. Part 1 provides children with their legal status and abolishes distinctions made between children born inside and outside of marriage. Part 2 covers the establishment of parentage and defines the circumstances under which a man is legally considered the father of a child, including circumstances in which the child was conceived as a result of artificial insemination with that man's or another man's semen. The third part deals with issues relating to child custody and access, including the rights and responsibilities of a person entitled to custody and access, various considerations to be taken into account by a court in awarding custody and access, and the procedure to be followed if a party has been denied access to a child. Part 4 sets out the provisions for assigning guardians of the property of a child.[Abstract] [Full Text] [Related] [New Search]
