    Abstract:
    Ireland's 1987 Status of Children Act 1) states that the marital status of a child's parents is to have no effect on the child's relationship to its mother and father; 2) allows the father of a child born outside of marriage to become the child's guardian; 3) gives children born outside of marriage the same maintenance and succession and other property rights as children born inside marriage; 4) establishes a new procedure to obtain a declaration of parentage even if no other relief is sought; 5) establishes a statutory regime for the use of blood test evidence to determine parentage; and 6) abolishes legal presumptions with respect to legitimacy and illegitimacy and replaces them with assumptions about paternity and nonpaternity based on the marital status of the mother and on the declaration of paternity stated in the registration of the birth. The Act also provides that a husband or wife can give evidence in any proceedings to prove that marital intercourse did or did not take place between them during any period.
