Title: Decree No. 89-95 of 10 February 1989 relating to adoption organizations. Author: France. Journal: Annu Rev Popul Law; 1989; 16():114. PubMed ID: 12344048. Abstract: This French Decree sets forth regulations on adoption organizations. It provides that any person or organization intending to serve as an intermediary for adoption or placement for adoption of a minor under 15 years old must obtain authorization to undertake this activity from the general council of each area where the activity will be performed. Documents relating to the status or background of the person or organization requesting authorization must be submitted to council, as well as documentation of all persons who will be involved in the process of adoption. The president of the local general council is to undertake all inquiries necessary to verify the documents and ensure the protection of children and parents and may not approve a request for authorization if any of the persons involved has been convicted of certain crimes or deprived of parental authority or does not possess the necessary professional qualifications. The Decree sets forth additional requirements for persons or organizations desiring to act as an intermediary for overseas adoptions, including approval by the Minister of Foreign Affairs. It also describes procedures to be undertaken with respect to individual adoptions, such as information to be provided to parents giving up children for adoption, to persons desiring to adopt, and to the president of the local general council about individual adoptions. Further provisions of the Decree deal with circumstances under which the president of the local general council can withdraw authorization for operation of local adoption activities and the Minister of Foreign Affairs can withdraw authorization for the operation of foreign adoption activities.[Abstract] [Full Text] [Related] [New Search]
