Abstract: This Honduras Decree amends the Family Code with respect to consent for adoption. It provides that a person who has reached the age of majority will give consent personally; that the guardian will give consent with court authorization in the case of a person who is subject to guardianship; and that the person or persons who exercise parental authority will give consent in a family court in the case of a person under the age of majority. A father who desires his child to be adopted because he is unable to provide for its education and the basic necessities of life must appear before the family court and make a declaration to this effect. The family court is to send notification to the National Board of Social Welfare, requesting that the concerned minor be taken into public care until placed with a family. No adoption of a minor will be allowed unless the conditions described above are complied with. When a person under the age of majority is the subject of an adoption request and has been declared abandoned or to be in the care of the court, a representative of the National Board of Social Welfare will give consent.[Abstract] [Full Text] [Related] [New Search]
