    Abstract:
    The Court ruled that it was not unlawful to terminate the defendant's pregnancy by reason only of her inability to give informed consent. She was a pregnant adult suffering from Down's syndrome and severe mental retardation. The Court held that the medical evidence showed that the abortion was in the defendant's best interest and that there was also a substantial risk that the child would be affected by Down's syndrome.
