Title: The crying need for an HIV statute. Author: Grover A. Journal: AIDS Asia; 1996; 3(3-4):2-6. PubMed ID: 12347627. Abstract: By 2000, India will have the largest number of reported HIV cases in the world. 22,520 HIV cases and 2528 AIDS cases were reported in India during May 1986 to April 1996. However, the numbers of cases are greatly underestimated and the National AIDS Control Organization and the Indian Health Organization estimate more like 1.78 and 4.4 million HIV cases, respectively, in the country. Goa is the only state in India with a law on HIV. The 1988 Goa Public Health Amendment Act legislated the mandatory testing of people suspected to be infected with HIV and the forced isolation of people who test HIV-seropositive. The provision of mandatory isolation was later made discretionary. The government at the federal level has decided that the provision of relevant education is the best way to prevent the spread of HIV. Some people believe that education is enough and law reform does not help. The author, however, argues that an integrationist strategy based upon education as the central component of HIV prevention must be backed up by legislation to prevent the spread of HIV infection and strengthen the rights of HIV positive persons against forced testing, isolation, breach of confidentiality, and discrimination.
