    Abstract:
    The paper presents issues associated with pronouncing opinions in cases of declaration of will invalidation for civil courts. The authors discuss differences between assessment of consciousness and discretion in last will and testament cases and in cases, where a living person attempts to invalidate his previous will drawn up by a notary. The objective of the report is an attempt at defining factors that play a significant role in formulating conclusions of such opinions, as well as determination of the competence of experts and indicating in what situations the adjudication of the case would be aided by a psychiatric opinion, a psychological opinion, or a complex opinion.
