Abstract: On June 21, 1976, a new West German legal code governing responsibility for abortions, replacing the old code of June 18, 1974, was implemented. Under the new code a doctor who, at the request of the patient, performs an abortion cannot be prosecuted indications for abortion lie under Provision 218a: if the patient, at least 3 days before the operation, confers with a specialist of with a gynecological clinic (128b); if the patient has conferred with a doctor as to the significant medical indication; or if the performing, responsible doctor has a written assessment from another doctor on the indications for the operation. Written clinical records should be made of the request and course of operation to be used in the event of legal action. The civil and penal codes allow approval for a minor operational interference only in those cases where the parents are unavailable or in cases where the operation is absolutely necessary for medical reasons.
